About Evidence
Relevance, character, opinion, hearsay, confrontation, and impeachment under the FRE. NCBE flags 9 of its topics at memorize level; the rest lean on provided materials and reasoning.
Free Evidence subject page: topics, sample questions, notes previewFrom chapter 1, Relevance & 403
Before a jury ever hears a single fact, that fact has to pass through two doors. Door one: is the evidence relevant — does it actually bear on the case? Door two: even if it is relevant, is it so dangerous, confusing, or wasteful that the judge should keep it out anyway? Relevance (Rules 401 and 402) is the price of admission, and it is a famously cheap ticket. Rule 403 is the judge's safety valve that can slam the second door on relevant-but-troublesome evidence. Almost every Evidence question you will ever see sits on top of these two ideas, so this is bedrock. This topic is starred, which means the exam expects you to recall the rules cold, with no rulebook in front of you. Memorize the two-part relevance test and the exact wording of the 403 balance.
