About Constitutional Law

Judicial power, federalism, due process, equal protection, and the First Amendment. NCBE flags 7 of its topics at memorize level; the rest lean on provided materials and reasoning.

From chapter 1, Judicial Power & Justiciability

Federal courts are powerful, but they are not roving problem-solvers. They cannot answer legal questions just because the questions are interesting or important. Article III of the Constitution limits them to deciding real 'Cases' and 'Controversies' — genuine disputes between opposing parties that a court order can actually fix. 'Justiciability' is the umbrella name for the doctrines that police that limit. Think of them as the locks on the federal courthouse door. Before a court ever reaches the merits of a claim, it asks four threshold questions: Is this the right plaintiff (standing)? Is this the right time (ripeness and mootness)? Is a court even allowed to answer, or is the issue reserved to another branch (the political question doctrine)? And is the court being asked for a real judgment rather than free legal advice (the advisory-opinion bar)? This topic then adds two structural pieces: when a private party may sue a state at all (the Eleventh Amendment and state sovereign immunity), and how far Congress can control what the federal courts are even allowed to hear (jurisdiction). This topic is starred, so you must recall these rules cold, with no statute supplied. The standing test in particular is a must-memorize.
